\nEstado de S\u00e3o Paulo, no desempenho de suas atribui\u00e7\u00f5es legais,
\nCONSIDERANDO o Procedimento Administrativo de Acompanhamento
\n(PAA) sob n.\u00ba 62.0205.0000797\/2020-9, que tem por objeto justamente acompanhar o
\ncontrole e preven\u00e7\u00e3o de prolifera\u00e7\u00e3o do Coronav\u00edrus, no \u00e2mbito do Sistema \u00danico de Sa\u00fade
\n(SUS), sob o comando da Secretaria da Sa\u00fade do Munic\u00edpio de Barretos\/SP, bem como as
\nrespectivas medidas de flexibiliza\u00e7\u00e3o do isolamento social doravante adotadas pelo
\nExecutivo local;
\nCONSIDERANDO a RECOMENDA\u00c7\u00c3O do Minist\u00e9rio P\u00fablico do Estado
\nde S\u00e3o Paulo, 1.\u00ba Promotor de Justi\u00e7a, ao Senhor Prefeito Municipal de Barretos, para que
\nrealize as altera\u00e7\u00f5es necess\u00e1rias nos Decretos Municipais, em estrita obedi\u00eancia \u00e0s medidas
\nprevistas no \u201cPlano S\u00e3o Paulo\u201d e limita\u00e7\u00f5es impostas por meio do Decreto Estadual n.\u00ba
\n64.994, de 28\/05\/2020, bem como de acordo com o entabulado no bojo do PAA e na r.
\ndecis\u00e3o judicial proferida nos autos da A\u00e7\u00e3o Civil P\u00fablica n.\u00ba 1004054-90.2020.8.26.0066, da
\n2.\u00aa Vara C\u00edvel desta Comarca, proibindo, de imediato, que haja consumo local de
\nalimentos em bares, restaurantes, lanchonetes e cong\u00eaneres,
\nCONSIDERANDO ainda que, caso n\u00e3o cumprida a recomenda\u00e7\u00e3o, o
\nMinist\u00e9rio P\u00fablico do Estado de S\u00e3o Paulo poder\u00e1 judicializar a quest\u00e3o, causando ainda
\nmais preju\u00edzos para a retomada da atividade de v\u00e1rios segmentos da economia local;
\nD E C R E T A:
\nART. 1.\u00ba – Fica alterado o inciso III do artigo 2.\u00ba do Decreto n.\u00ba 10.585, de 29 de junho
\nde 2020, com altera\u00e7\u00f5es subsequentes, o qual contar\u00e1 com a seguinte
\nreda\u00e7\u00e3o:

\nIII – alimenta\u00e7\u00e3o como bares, lanchonetes, restaurantes,
\npizzarias, pastelarias, hamburguerias, quiosques, food

\ntrucks e cong\u00eaneres, permitido servi\u00e7os de entrega
\n(delivery) e que permitem a compra sem sair do carro (drive
\nthru), sendo proibido o consumo no local. (NR)\u201d
\nART. 2.\u00ba – Fica alterado o inciso IV do artigo 2.\u00ba do Decreto n.\u00ba 10.585, de 29 de junho
\nde 2020, com altera\u00e7\u00f5es subsequentes, o qual contar\u00e1 com a seguinte
\nreda\u00e7\u00e3o:
\n\u201cART. 2.\u00ba – …
\nIV – doceterias, sorveterias, gelaterias, lojas de conveni\u00eancia,
\ncafeteria, padarias e cong\u00eaneres, sendo proibida a entrada
\nde crian\u00e7as de at\u00e9 doze anos de idade incompletos,
\ndevendo a comprova\u00e7\u00e3o da idade ser realizada mediante
\ndocumento de identidade, sob pena de multa para o
\nestabelecimento no valor de R$100,00, dobrada na
\nreincid\u00eancia at\u00e9 o limite de R$5.000,00 para o
\nestabelecimento e de R$100,00 para o respons\u00e1vel pela
\ncrian\u00e7a, sendo terminantemente proibida a modalidade de
\nself service e proibido o consumo no local; (NR)\u201d
